Welcome to Banana Butter Bakery. By placing an order through our website, social media accounts, or any other ordering platform, you agree to the following Terms & Conditions.
Compliance with NY State Law
Banana Butter Bakery operates strictly in accordance with New York State Home Processor regulations in a dedicated kitchen. Our products are available only for delivery or pickup within New York State. We do not ship products outside of New York State and reserve the right to refuse or cancel any order that does not comply with applicable state regulations.
New York State Home Processor Disclosure
Banana Butter Bakery operates under the New York State Home Processor Exemption in a dedicated kitchen and is approved to produce non-potentially hazardous baked goods in a residential kitchen. Products are prepared in a home kitchen that has not been inspected by the New York State Department of Health.
Product and Allergen Disclaimer
Our products are prepared in a shared residential kitchen environment that may contain or come into contact with common allergens, including but not limited to:
- Wheat
- Milk
- Eggs
- Soy
- Peanuts
- Tree Nuts
While we take reasonable precautions when preparing our products, we cannot guarantee that any item is completely free of allergens or cross-contact. Customers with food allergies, sensitivities, or dietary restrictions purchase and consume our products at their own risk. Ingredient information is available upon request.
Ordering, Payment, Deposits, and Cancellations
All orders are subject to availability and are not confirmed until full payment has been received. Because our cookies are baked to order and produced in limited quantities:
- Cancellation requests must be submitted within 24 hours of placing an order.
- Refund requests must be submitted within 24 hours of delivery or pickup.
Requests submitted after these timeframes may not be eligible for a refund.
Banana Butter Bakery reserves the right to approve or deny refund requests at its sole discretion. Once a weekly drop sells out, additional inventory may not be available.
Banana Butter Bakery also reserves the right to refuse service to customers who are disruptive, rude, threatening, or who violate any posted store policies.

Pickup, Delivery, and Product Responsibility
Customers are responsible for providing accurate delivery and contact information. Once products have been picked up, delivered, or otherwise leave the physical control of Banana Butter Bakery, responsibility for their condition, storage, handling, and consumption transfers to the customer. We are not responsible for damage, deterioration, melting, spoilage, theft, delays caused by third-party carriers, or other issues occurring after delivery or pickup has been completed.

Limitation of Liability
By purchasing from Banana Butter Bakery, customers acknowledge and accept all risks associated with the consumption of baked goods, including potential allergic reactions. To the fullest extent permitted by law, Banana Butter Bakery, it's owners, partners, and employees, and it's successors and/or assigns, shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the purchase, handling, storage, or consumption of our products.
